By accessing or using the services of Xclusive Tan, you agree to the following Terms & Conditions.
1. Services
Xclusive Tan provides tanning and related personal care services. All customers are required to complete and sign a tanning consent and release form prior to receiving services. Services are provided subject to availability and salon policies.
2. Compliance With Tanning Regulations
Xclusive Tan operates in accordance with applicable federal, state, and local tanning regulations. Customers acknowledge that tanning services involve exposure to ultraviolet (UV) radiation and that potential risks associated with UV exposure have been disclosed through required consent forms and in-salon signage.
Customers agree to follow all posted safety instructions, session guidelines, and staff directions. Protective eyewear is required during all tanning sessions. Age restrictions and identification requirements apply in accordance with applicable law.
3. Assumption of Risk
By using Xclusive Tan’s services, customers voluntarily assume all risks associated with tanning services, including but not limited to skin irritation, burns, premature skin aging, or other skin-related conditions. Customers are responsible for monitoring their own skin condition and determining whether tanning services are appropriate for them.
4. Eligibility
Customers must meet all age, identification, and health requirements required by law and salon policy. Xclusive Tan reserves the right to refuse service if eligibility requirements are not met.
5. Payments, Packages & Memberships
All purchases, packages, memberships, and services are non-transferable and non-refundable unless otherwise required by law. Pricing, session limits, expiration terms, and availability are disclosed at the time of purchase and are subject to change.
6. Appointments, Cancellations & No-Shows
Certain services may require appointments. Cancellation or no-show policies may apply and may result in forfeited sessions or applicable fees.
7. SMS Communications
Xclusive Tan may send transactional text messages related to customer accounts or services, including receipts, payment links, appointment confirmations, and account notifications. Consent for transactional messaging is collected through a written tanning consent and release form.

Promotional or marketing text messages, if sent, are delivered through a separate system and phone number and require separate customer consent.
8. Limitation of Liability
To the fullest extent permitted by law, Xclusive Tan is not liable for indirect, incidental, or consequential damages arising from the use of its services, facilities, or communications, including delays or failures in SMS message delivery.
9. Changes to Terms
Xclusive Tan reserves the right to update or modify these Terms & Conditions at any time. Continued use of services constitutes acceptance of any changes.
10. Governing Law
These Terms & Conditions are governed by the laws of the state in which Xclusive Tan operates.
